Terms of Service

SERVER USE

Personal accounts are to be used by the primary owner only, account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

OneHostingPlan.com reserves the right to refuse service and/or access to its servers to anyone.

OneHostingPlan.com does not allow any of the following content to be stored on its servers:

- Illegal Material - This includes copyrighted works, commercial audio, video, or music files and any material in violation of any Federal, State or Local regulation.

- Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of OneHostingPlan.com.

- Online/Offline Games and Anime Sites - Includes all online/offline Casinos, Jumpling, MUDs, Egg Drop,any kind of interactive gaming on our servers, Anime communties, PlayStation games Forums, news, reviews.

- Hate material - We define hate material as that which expresses or promotes hatred among groups of people. For instance, racist, anti-Semitic, religions matters and homophobic is hate materials. We reserve the right to identify hate material for what it is (including identifiers on the members sites).

- Portals - Includes any size of portals for any porpuses .

- Warez - Includes pirated software, ROMS, emulators, freaking, hacking, password cracking, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

- Streaming Media - we dont allow any kind of streaming media legal or illegal including real audio, real video, QuickTime, ... we accept the Flash/Shockwave only as streaming media.

- Invalid or untransfered domains - all accounts must be have registered domains and hold our name servers, accounts without registered or transfered domains will be terminated automatically after a month of singing up without warnings and all payments will be unrefundable.

System Resource Usage

If the OneHostingPlan.com system administrator team determines that a user/client is exceeding the acceptable amount of system resources, be it bandwidth, disk space, processor capabilities, etc., OneHostingPlan.com reserves the right to temporarily or permanently deactivate the account that has caused the infraction. Refunds may or may not be issued depending on individual cases. Accounts using up enough resources to slow or crash the server will be promptly shutdown. Additionally, flat-file based message boards, such as Ultimate Bulletin Board (UBB), Ikonboard, or YaBB are strictly prohibited due to excessive resource drainage. The final decision resides with the management of OneHostingPlan.com.

Excessive Bandwidth Use

Each account comes with its own bandwidth limit. OneHostingPlan.com expects its users to comply with their Terms of Service, and not abuse bandwidth. If a client goes over the monthly limit, they agree to pay for that excess.
Currently, OneHostingPlan charges $2 per gigabyte or leftover part of a gigabyte. If a client exceeds his bandwidth amount for the month, they agree to either: comply by OneHostingPlan's policy and pay for each gigabyte used, upgrade their account, or risk temporary suspension or termination of their account. OneHostingPlan.com reserves the right to make the final decisions.

ACCOUNT TERMINATION

OneHostingPlan.com logs and monitors all server activities. Any snooping, malicious hacking or other activity outside of your account, deemed unsuitable by OneHostingPlan.com, will be grounds for termination with no refund. If you are unsure if what you are doing will lead to Account Termination, do not hesitate to contact us. Since there are no refunds granted for accounts terminated due to Terms of Service violations, it is in your best interests to contact us if any doubts exist. The Terms of Service may be amended, at any time, to the sole discretion of OneHostingPlan.com. All hosting accounts are required to comply with any changes. Notifications will only be sent on major changes to the terms of service.

Chat Rooms

OneHostingPlan.com prohibits chat rooms, since they have high resource consumption. As such, we do not allow clients to install their own chat programs.

IRC

OneHostingPlan.com does not allow IRC or IRC bots to be operated on our servers.

Background-Running Programs

These are considered on an individual basis, and per request. Extra charges may be incurred based on system resources used and operational maintenance needed.

Unsolicited E-Mail (Spam)

We absolutely do not allow spam in our servers. Our upstream has strict limitation on spam. We have a ZERO Tolerance for SPAM and any domain found spamming will be TERMINATED from our servers immediately. All cases are thoroughly investigated, and at first complaint of spam the account will be put on hold until further investigation is done. Spamming, or the sending of unsolicited email, from a OneHostingPlan.com server or using an email address that is maintained on a OneHostingPlan.com machine is STRICTLY prohibited. OneHostingPlan.com will be the sole arbiter as to what constitutes a violation of this provision. For general reference, we consider spam any email that is sent to more than 15 people at a time that did not ask for it to be sent to them.

Changes to Terms of Service

OneHostingPlan.com reserves the right to change the Terms of Service without notification. Any major changes to the Terms of Service will result in a notification to all current customers.

Guarantee

We will make every reasonable attempt to avoid unforeseen server downtime and to also ensure that all of our hosting accounts are properly taken care of. Due to the nature of the internet, we cannot predict server downtime. We have taken steps to ensure minimal server downtime, and thus if the server is down for more than 0.2% in any month, a refund will be offered at a pro-rated amount. Account backups are ultimately the account holders responsibility.

PAYMENT POLICIES

All accounts are set up on a prepay basis. Although OneHostingPlan.com reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers WILL automatically be charged again at the end of their prepay period .

In situations where the card number on file is declined OneHostingPlan.com will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, OneHostingPlan.com reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was to reactivate a suspended account (due payment problem) a $12.50 reactivation fee must be paid for each suspended domain/account established to the time that the customer sends a written cancellation request

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via e-mail shortly after the online purchase has been made. At this point the customer's card will be charged automatically. All payment is only accepted in US dollars.

PAYMENT OPTIONS

In order to streamline our accounting procedures and keep costs down OneHostingPlan.com accepts Mastercard, Visa (not Visa electron), Discover and American Express.

CANCELLATION AND REFUNDS

OneHostingPlan.com reserves the right to cancel the service at any time. Customer refund requests are to be sent to sales@OneHostingPlan.com and will only be processed in the cases of service non-performance that might be caused by OneHostingPlan.com's side, Refund requests will be refused if it's requested for any cause that's out of OneHostingPlan.com's side, For example:
- Domain transfer failure.
- Failure of any third party programs that's not supported by OneHostingPlan.com
- Customers leakage of experience in dealing with web basics and communication protocols

INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold OneHostingPlan.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against OneHostingPlan.com, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless OneHostingPlan.com against liabilities arising out of:
(1) any injury to person or property caused by any products sold or otherwise distributed in connection with OneHostingPlan.com's server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from OneHostingPlan.com's server.

DISCLAIMER

OneHostingPlan.com will not be responsible for any damages your business may suffer, OneHostingPlan.com makes no warranties of any kind, expressed or implied for services we provide. OneHostingPlan.com disclaims any warranter merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by OneHostingPlan.com and its employees.

OneHostingPlan.com reserves the right to revise the above mentioned policies at any time.
